Welcome to Hamfaza. These Terms of Service ("Terms") govern your access to and use of Hamfaza's Instagram management services.
Hamfaza is a brand and platform owned and operated by Apex Petro Gas LLC, a legally registered company in Qatar. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms
By accessing or using Hamfaza, you confirm that you can form a binding contract with us, that you accept these Terms, and that you agree to comply with them. Your access to and use of our services is also subject to our Privacy Policy, the terms of which can be found at hamfaza.com/privacy.

2. Eligibility
Account Requirements
Instagram Account
You must have a valid Instagram Business or Creator account to use our services.
Age Requirement
You must be at least 13 years old. If under 18, you need parental consent.
Legal Authority
You must have the legal authority to accept these terms on behalf of yourself or your organization.
3. Use
Compliance with Meta Policies
Your use of Hamfaza is subject to and must comply with:

- Instagram Platform Policies
- Instagram Terms of Use
- Instagram Community Guidelines
- Facebook Data Policy
API Permissions
By connecting your Instagram account, you grant us permission to:
Important Restrictions
Hamfaza does NOT and will NOT:
- Automate any actions without your explicit initiation
- Send bulk messages or spam
- We do not permanently store Instagram content such as posts, comments, or messages beyond temporary processing required to perform user-initiated actions.
- Share your Instagram data with third parties
- Violate Instagram's rate limits or terms

Consequences of Violation
Violation of these prohibited uses may result in immediate termination of your account, legal action, and reporting to Instagram/Meta. We reserve the right to investigate and take appropriate action against anyone who violates these terms.
5. Intellectual Property Rights
Our Rights
Hamfaza and its original content, features, and functionality are owned by Apex Petro Gas LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Your Rights
You retain all rights to your Instagram content. We do not claim ownership of any content you post through Instagram.
License Grant
You grant Hamfaza a limited, non-exclusive, revocable license to access your Instagram content via the Instagram & Facebook Graph API solely for the purpose of providing our services to you. This license terminates when you disconnect your Instagram account from our service.
6. Termination
By You
You may terminate your account at any time by disconnecting your Instagram account. If you need assistance, you may contact us at support@hamfaza.com.
You may revoke Hamfaza’s access to your Instagram account at any time by disconnecting the app through your Meta (Facebook) account settings. Once access is revoked, Hamfaza will no longer be able to access or process your Instagram data.
This revocation can be performed directly by the user without contacting Hamfaza.
By Us
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Effect of Termination
Upon termination, your right to use our services will immediately cease. We will delete your data according to our Privacy Policy.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, INCLUDING THAT THE SERVICE WILL OPERATE ERROR-FREE OR THAT THE SERVICE IS FREE OF COMPUTER VIRUSES OR SIMILAR CONTAMINATION OR DESTRUCTIVE FEATURES.
WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE.
8. Limitation of Liability
IN NO EVENT SHALL HAMFAZA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
- ANY CONTENT OBTAINED FROM THE SERVICE
- UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
Maximum Liability
IN NO EVENT SHALL HAMFAZA'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT YOU HAVE PAID HAMFAZA IN THE LAST SIX MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).
9. Governing Law
These Terms shall be governed and construed in accordance with applicable international laws, without regard to conflict of law principles.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the service.
